Terms of Service

These Terms of Service (“Terms”) govern your use of Markdown Writer, the website at markdownwriter.com, the browser-based editor, the conversion tools, document publishing, cloud sync, image hosting and any related services (together, the “Service”), operated by Markdown Writer (“we”, “us”). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age required in your country to consent to online services) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

The core editor runs entirely in your browser and stores your documents locally on your device. It is free to use and does not require an account.

Optional features require an account and, in some cases, a paid subscription (“Pro”): syncing documents across devices, uploading and hosting images, and any other features we label as Pro. We may add, change or remove features at any time. Where a change materially reduces a paid feature, we will make reasonable efforts to notify subscribers in advance.

You can sign in with a third-party identity provider (such as GitHub, Google or Microsoft) or with a passkey. You are responsible for the security of the devices and accounts you use to access the Service and for all activity that happens under your account. Tell us promptly at hello@markdownwriter.com if you believe your account has been compromised.

You may delete your account at any time from within the Service or by emailing us. Deleting your account removes your synced documents, uploaded images and profile from our systems, subject to the retention periods described in the Privacy Policy.

• Pricing. Pro is billed as a recurring subscription at the price shown at checkout. Prices are in U.S. dollars unless stated otherwise and exclude any applicable taxes, which you are responsible for.
• Free trial. New subscriptions may include a free trial. If you do not cancel before the trial ends, your payment method will be charged for the first billing period.
• Renewal and cancellation. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account settings; you keep Pro access until the end of the period you have already paid for, after which your account reverts to the free tier. Synced documents remain available for download for a reasonable period after cancellation.
• Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods. If you believe you were charged in error, contact us and we will look into it.
• Payment processing. Payments are processed by Stripe. We do not store your full card details. Stripe’s own terms and privacy policy apply to the payment transaction.
• Price changes. We may change subscription prices. Changes apply at your next renewal and we will give you at least 30 days’ notice by email or in the Service.

You own the documents, images and other material you create or upload (“Your Content”). We claim no ownership of it.

To operate the Service you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, back up and display Your Content solely as needed to provide the features you use — for example, storing a synced document, serving an uploaded image, or rendering a document you chose to publish. This licence ends when you delete the content or your account, except for copies held in routine backups for a limited period and content you published that others have already received.

We do not use Your Content to train machine-learning models, and we do not sell it.

You are responsible for Your Content. You represent that you have the rights needed to store and, where you choose, publish it, and that it does not violate these Terms or any law.

If you use the publish feature, the document you publish is placed at a public URL that anyone with the link can read, and may be indexed by search engines. Do not publish anything confidential. You can unpublish a document at any time, after which the URL stops serving it; copies cached by third parties are outside our control.

We may remove published content that we reasonably believe violates these Terms or applicable law, and may suspend publishing for accounts that repeatedly do so.

You agree not to use the Service to:

• store, publish or distribute content that is unlawful, infringing, defamatory, harassing, hateful, sexually exploitative of minors, or that incites violence;
• distribute malware, phishing pages, spam or other deceptive material;
• infringe anyone’s intellectual-property, privacy or publicity rights;
• probe, scan, overload, disrupt or attempt to gain unauthorised access to the Service or its infrastructure, or circumvent usage limits or paywalls;
• scrape or bulk-download content from the Service except as permitted by our robots.txt or with our written permission;
• resell or sublicense the Service, or use it to build a competing hosted service, without our permission.

We may set reasonable limits on storage, bandwidth, request rate and file size, and may suspend or terminate accounts that violate this section.

If you believe content hosted on the Service infringes your copyright, send a notice to hello@markdownwriter.com identifying the work, the URL of the allegedly infringing material, your contact details, and a statement that you believe in good faith the use is unauthorised. We will review it and remove or disable access to infringing material where appropriate, and may terminate accounts of repeat infringers.

The Service — including its software, design, text and trademarks — is owned by us or our licensors and protected by intellectual-property laws. These Terms do not grant you any right to use our name, logo or branding. Open-source components included in the Service remain subject to their respective licences.

The Service relies on third-party providers such as Cloudflare (hosting, storage and image delivery), Stripe (payments) and the identity providers you choose to sign in with. Their availability and terms are outside our control. Links to third-party sites are provided for convenience and we are not responsible for their content.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if continuing to provide the Service to you would create risk to us or others. Where practical we will notify you and give you a chance to export your data.

We may discontinue the Service or any part of it. If we discontinue a paid feature, we will give reasonable notice and refund any prepaid fees for the unused portion of the current billing period.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT DATA WILL NOT BE LOST. KEEP YOUR OWN BACKUPS OF ANYTHING IMPORTANT. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) US$50. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

You will defend and indemnify us against claims, damages and reasonable expenses (including legal fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. For material changes we will give notice in the Service or by email before they take effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules, and any dispute will be resolved in the state or federal courts located in Virginia, unless mandatory consumer-protection law in your country of residence provides otherwise. Before filing a claim, you agree to contact us and make a good-faith attempt to resolve the dispute informally.

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
